Legal Victory for OK Death Row Inmates and Their Attorneys (Feb 02, 2006)
Oklahoma inmates on death row and their attorneys scored a significant victory in a federal court this week. The 10th Circuit Court of Appeals in Denver ruled that federal funds could be used to pay attorneys for Oklahoma death row inmates for their work in clemency hearings. That reversed a lower court’s 2004 decision that Congress didn’t intend to use federal funds for that purpose. The process of representing inmates in clemency hearings is extremely costly, and some attorneys had threatened to refuse to take such cases if they were not paid. KGOU speaks with Norman attorney Steve Presson of the law firm of Jackson and Presson (4 minutes).
