Judge Hears Testimony in Resentencing Trial (Oct 19, 2010)

LAWTON, Okla. (AP) — The sister of a former firefighter who was convicted of first-degree murder and sentenced to death for the killing of an Oklahoma Highway Patrol trooper says she introduced her brother to methamphetamine after their mother died.

Tammy Sturdevant also testified Tuesday that Ricky Malone's behavior changed as he descended into addiction and began "cooking" the drug. Sturdevant says Malone shot at her once because he believed she had stolen from him.

Comanche County District Judge Mark Smith is hearing testimony in the resentencing trial for Malone, whose punishment was overturned on appeal. Authorities say he shot Trooper Nik Green on Dec. 26, 2003, after Green caught him operating a meth lab in a car on a Cotton County road.

Several of Malone's former coworkers at a Lawton ambulance service also testified that Malone's personality changed, with him becoming angrier over time.
