Incoming Okla AG to Challenge Health Care Law (Jan 07, 2011)

OKLAHOMA CITY (AP) — Oklahoma's incoming attorney general says he plans to file a separate legal challenge against the federal government over the new federal health care law.

Republican Attorney General-elect Scott Pruitt said Friday he plans to file a lawsuit soon after he's sworn into office on Monday. Oklahoma would be the third state to file its own legal challenge. Similar lawsuits have been filed in Virginia and Florida.

Pruitt said Oklahoma should file its own legal challenge because Oklahoma voters in November approved a constitutional amendment that prohibits forced participation in a health care system.

He says the most logical way to defend Oklahoma's constitution is by filing the lawsuit in federal court in Oklahoma.

Pruitt says a separate challenge also will include an additional circuit court to consider arguments.
