Texas Water District Appeals Okla. Water ruling (Jan 19, 2012)

OKLAHOMA CITY (AP) - A North Texas water district is appealing to the U.S. Supreme Court the dismissal of a federal lawsuit that seeks access to water supplies in southeastern Oklahoma.

Tarrant Regional Water District General Manager Jim Oliver says in an e-mail to The Associated Press that the appeal was filed Thursday with the nation's highest court.

A federal appeals court in September upheld the dismissal of the lawsuit to transfer Oklahoma stream and surface water to Fort Worth, Arlington and surrounding communities.

The district wanted to invalidate Oklahoma laws governing the appropriation and use of water within its boundaries that North Texas communities alleged posed burdens to interstate commerce.

In spite of the appeal, Oliver says the district is still willing to negotiate with the state to purchase new supplies of water.
