Pharmacist's Murder Trial to be Delayed (Nov 15, 2010)

OKLAHOMA CITY (AP) — The murder trial of an Oklahoma City pharmacist accused of gunning down a teen during a robbery will be delayed again while attorneys argue over whether the judge in the case should step down.

Prosecutors filed an objection Monday to a motion by pharmacist Jerome Ersland's attorneys to remove Judge Ray Elliot from the case.

Elliot agreed Monday to hear arguments on the matter Dec. 6, the same date Ersland's first-degree murder trial was to begin.

Defense attorney Irven Box alleges Elliot's wife — who works in the district attorney's office — discussed the case with the judge, and that the judge used racial slurs.

Prosecutors say there is no evidence to support Box's allegations, and even if there was, there is no evidence that would deprive Ersland of a fair trial.
