Osage Nation Loses in Wind Farm Dispute (Dec 16, 2011)

A federal judge has turned away a request by the Osage Nation to block a proposed wind farm.

U.S. District Judge Gregory Frizzell issued the ruling yesterday after hearing testimony that the wind farm can co-exist with oil drilling that is planned on the same land in Osage County.

The Osage Nation claims in its lawsuit that it owns all the mineral rights “in and under” Osage County and that the proposed wind turbines would interfere with other energy development.

Developers of the wind farm say they need to start construction in time to finish before the end of 2012, when a federal tax incentive expires.
